Description:Dear Sir/ Madam,

My brother was originally diagnosed in the beginning of 2009 as a result of difficulty urinating and extreme pain. He consulted with his doctors multiple times over 2009 for prep for surgical procedure but they delayed and gave temporary procedures to allow urination (1st procedure removed scar tissue blocking passage; 2nd was to put in a catheter after tissue returned--catheter remained in for extended periods of time ( 2 - 3 months at a time); 3rd was to remove the catheter and place a small incision near my stomach area to allow my waste to be removed through a tube that I've had to wear around my neck to support; 4th upon replacing the tube the physician yanked the tube from its location claiming I wouldn't feel it even though I'd already complained of extreme pain and discomfort.)

He later learned that the physician had performed a partial castration without his consent. To date, almost a year later, he is still wearing a tube to eliminate waste and the corrective procedure has not been performed.

What recourse does he have, if any? Can or should he file a medical malpractice law suit? If so, is it to late seeing as though these happening began about Feb. 2, 2009?

Please advise.

Please note, that my brother received all of his care under the care of the Tennessee Department of Correction as he is an inmate with a release date of 2012.

Lastly, if he files with the court "a pauperis" tomorrow can he later retain an attorney to represent him?
