I am a over wieght gay male weighing in at almost 320lbs, i started working for this major gas and oil company at one of its stores here in virginia. when i first started working there things with the management and emploee's were fine, but when a few of the employees asked me what was my position i told a few that i am reg sales but will be going for the management position. Every since that day things started to get a little rocky, a week later one of the assistant managers got into a dissagrement with me about a customers order (because we sell food as well) after all was said (no foul language) not even loud voices just a dissagreement 2 days later i beging brought into the office and suspended for susp. of drug use because the assistant manager as well as an unnamed employee said that i was very hyperactive as well as she noticed my eyes were dialated and my nose was running, now mind you part of more store duties consist of me going outside and changing a total of 42 garbage cans outside the store and gas pumps and at that time it was almost 2 feet of snow and 12-14 degrees outside and im out in the weather changing garbage cans for almost an hour so when i came in and my nose was running they said it was a suspicion of drug use well they didnt exactly say drug use they said personal problems as they put it and i was suspended untell furthur notice. needless to say i was suspended for almost 2 weeks which i did not understand because i just took a drug test 2 weeks prior to gaining employement with the company,i also at my interview told the store manager and assiatant that i had a few mental problems far as hdhd and i am very hyper. so when i threated to get a lawyer they dropped the susp. and let me return to work as wella s paid me for the days i was out. so after that was said and done this reg employee who use to be a store manager started to rudely harrass me and say derogitory statements to me and other employees about me, some i will hear and some other employees would come and tell me i told every level of management in the store that she was calling me out of my name racialy but all they would tell me is thats just they way she is and did nothing. so weeks go by of the abuse and after several attemps to allert management still nothing accured she would call me a "gay punk" in front of other management and employees and still nothing was done, she would make statements like "who would want to sit beside something like that" and my favorite "your nothing but a big punk" so once again after management was aware of this they still did nothing because mostly being that this lady was a store manager at one point she can and do most of the other managers duties while they just sit around and relax so if they let her go then it would be more responsiblities on there part which they are suppose to do from the begining, needlss to say about a month later a customer came intot he store and hit the wrong button on the order screen by mistake h wanted a 6 inch sub instead of a 12 inch sub one would think this would be a easy sovlable mistake, so i go to the back and ask the lady being she was the one making the oer very nicely can she make the sub a 6inch she replied its already made so he has to pay for it, which is unherd of inn customer service to me, so i simply just asked her to pleas ejust give him half of the sub as we will only charge him for half which is the 6 inch h wanted. so after the oerder was given to the customer i say about a good 35 seconds later when i think everything was ok and nothing was the matter she b-lines it straight to my section of the store and got in my face and started to say "yoou young punk dont you every go against what i say back off" and this was infront of other customers and management and i simply replied "your to old to act liek that" and it did nto sit well with her so by this time the assiatant who witness the whole thing was already making her way to the office with the lady and the store manager and the end they said i was wrong for saying she was to old to act liek that when she really was and nothing was done. so 2 days later we had a store meeting were all the employees and management had to be there i came in and sat on the other side of the room when the lady came in she looked directly at me and came and sat right infront of me so me and another girl nicely got up and sat on the other side of the room and she looked again and moved to the other side and sat right back in front of me again so i just paid it no mind. during the meeting when we were asked to voice our concerns evrytime i would say something she would rudely interupt me and siad crude things out of her mouths like "you dont kow jack" and "shut up what do you know" and still once again management did nothing, so the 3rd time i went to speak she interupted me and i asked her to stopped interrupting me as i did not her and she just went crazy and stood up turned around and proceeded to say " you fat punk i am sick of you i hate you" as i proceed to put my hand up to block the spit that was comming out of her mouth as she spoke to took my hand and twisted it to the point my wrist cracked, it did not cause much paid but it did hurt so instantly i reacted and started to yell " i cannot believe ya'll allow this kind of treatment to an employee" the only thing i got was hat i need to sit don and shut up from the store manager so after a few seconds i sat back down in rage and the meeting was closed and i walked outside as soona s i walked outside several employees came to me and told me that that was wrong how i been treated and that it has been a conspiracy to get me out of the company and they will be glad tot estify on my behalf because enough is enough they have sat back to long to allow this to keep happening to me, so after we left i went back tot he store the store manager did not return so the next day i come to work they said that i was suspended as well as her untell furthur notice pending investigation. in closeing i want to know do i have a case? i went threw all proper channels in telling management about the mistreatment but nothing was done so it got so out of hand i was assaulted at a meeting (i did press charges) and then i get suspended a second time within 3 months of employement i went threw mental and now physical abuse. can someone help?
